Abstract

The present work aims to prove that, in spite of the literal meaning of the article 1.192 of the Chilean Civil Code, it is possible to sustain that the “conditions” established by the articles 166 and 250 Nº 2 of the same Code are applicable to the legal portion, because, strictly speaking, those articles do not establish conditions.
