Abstract

This work exposes the meaning and scope of the requirement of “lack of sufficient provocation” required by article 10 N ° 4 of the Penal Code
to recognize the cause of justification of Self-Defense. For this, we will start by analyzing the concept of provocation, its requirements, historical
origins, and the different theories that criminal dogmatics have formulated about when it should be understood that it is enough. Then the different
types of provocation will be indicated in their subjective aspect.
